What are the documents which I need to submit and justify the right to purchase a property in Viet Nam? If the visa is required, does the foreign purchaser need to physically stay in Viet Nam?

Answers: 

(i) A Foreign individual must have a valid passport stamped and verified by the Immigration Department to prove their entry into Viet Nam and he/she not entitled to the privileges and diplomatic immunity under the provisions of the Ordinance on privileges and immunities for diplomatic missions, consulates and representative offices of international organizations in Viet Nam.

(ii) Subject to the provisions of Article 159 of the Law on Housing 2014, foreign organizations must have valid registration certificate of investment or document issued by the competent authorities of Viet Nam to allow for operating in Viet Nam at the time of conclusion of the transaction of purchasing.

In accordance with Article 159 of the Law on Housing 2014 mentioned above, the term "allowed to entry into Viet Nam” does not specify requirement for the foreign purchaser with a valid visa to physically stay in Viet Nam.  However, Article 74 of the Decree No. 99/2015/NO-CP uses the term "a valid passport stamped and verified by the Immigration Department to prove the entry into Viet Nam”. According to the immigration administration system of Viet Nam, the entry and exist of Viet Nam is subject to the term provided for in your visa and each time of your entry or exit will be recorded in your passport. Therefore, it depends on the interpretation of law enforcement agency as to whether that term require foreign purchaser need to physically stay in Viet Nam.
