Can foreign individuals have the right to purchase commercial floor space in the mix building?


Answers:

Under the provision of Article 3 of the Housing Law 2014:

1. Housing is any construction building for residential purposes and serve the daily needs of households and individuals.

As stipulated in Article 7 of the Housing Law 2014, the object is allowed to own houses in Vietnam includes:

3. Foreign organizations and individuals are stipulated in Clause 1 of Article 159 of this Law.

In Article 159, the Housing Act 2014 states:

Under the provision of Article 3 of the Housing Law 2014:

1. Housing is any construction building for residential purposes and serve the daily needs of households and individuals.

 

As stipulated in Article 7 of the Housing Law 2014, the object is allowed to own houses in Vietnam includes:

3. Foreign organizations and individuals are stipulated in Clause 1 of Article 159 of this Law.

In Article 159, the Housing Act 2014 states:

1. Foreign organizations and individuals are allowed to own houses in Vietnam include:

a) Foreign organizations and individuals investing on housing construction of projects in Vietnam under the provisions of this Law and other relevant laws;

b) Enterprises with foreign investment, branches or representative offices of foreign enterprises, foreign investment funds and foreign bank branches operating in Vietnam (hereinafter referred to as foreign organizations);

c) Foreign individuals are allowed to enter Vietnam.

2. Foreign organizations and individuals are allowed to own houses in Vietnam through the following forms:

a) Investing on housing construction of projects in Vietnam under the provisions of this Law and other relevant laws;

b) Purchasing, leasing, donation or inheritance of commercial housing including apartments and separate houses in the investment projects of housing construction, except for areas to ensure defense and security according to Government regulations.

Thus, there is no law that allows foreign individuals and organizations to purchase commercial floor area of ​​complex buildings.
